By using our website or purchasing from our store, you agree to the following terms and conditions, which are designed to ensure clarity, trust, and a premium experience for you.

1. Your Account and Access

To shop with us, you must be the age of majority in your state or territory. If you're under 18, a parent or guardian must consent to your use.

When placing an order or creating an account, please ensure your information is accurate, complete, and up to date. You're responsible for any activity that occurs under your account.

2. Our Products

Every Balterra frame is thoughtfully crafted to embody timeless design and functional wellbeing. While we strive to present products as accurately as possible, colours and details may appear differently depending on your device or screen settings.

Our eyewear is created for personal use only, and we reserve the right to limit purchases if we suspect resale or misuse.

We may update, refine, or discontinue styles from time to time as part of our commitment to innovation.

3. Orders

Your order is an offer to purchase, and we reserve the right to accept or decline it at our discretion. Once your payment is processed and confirmed, you'll receive an order confirmation via email.

If you need to make changes after placing an order, contact us promptly, though we cannot guarantee updates once the order is processed.

All purchases are subject to our Refund Policy.

4. Pricing and Payment

All prices are listed in Australian Dollars (AUD). Prices shown include GST unless otherwise stated. Shipping and express options may be calculated at checkout.

We accept major credit cards, PayPal, and Shopify Payments. You agree to provide accurate billing and contact details so your order can be fulfilled smoothly.

Promotional offers may be subject to separate terms and may not be combined.

5. Shipping and Delivery

We dispatch directly from our Melbourne location with tracking on all orders. Once your parcel is with our delivery partners, we are not liable for delays due to postal congestion or carrier issues. Our support team is always here to assist with any tracking or delivery concerns.

6. Intellectual Property

All content on our site, including logos, images, copy, and product names, belongs to Balterra and is protected under intellectual property law.

You may not reproduce, copy, or use our content without written permission. We deeply value the originality of our work and the trust of our community.

7. Optional Tools and Third Parties

We may offer integrations or links to tools powered by third parties. These are offered "as-is" and come without warranties or endorsements. Use of third-party features is at your own discretion.

8. Feedback

We love hearing from our customers. Any suggestions, reviews, or ideas shared with us may be used to improve Balterra, and by submitting them, you grant us permission to do so.

9. Returns and Exchanges

We offer a 30-Day Right Fit Guarantee to ensure your experience is seamless.

You're welcome to wear your glasses while you decide if they're right for you. To be eligible for return, they must be undamaged, in their original case and packaging.

Returns made within 30 days of delivery are refunded in full. Returns made between 31 and 60 days of delivery are accepted with a 20% restocking fee deducted from the refund. We're unable to accept returns after 60 days from the date of delivery.

To begin a return or exchange, email info@balterra.au with your order number and request. Our team will guide you through the next steps and authorise your return. Full detail is set out in our Refund Policy, which forms part of these Terms.

Please note: items returned without prior authorisation may not be accepted. Gift cards and sale items are final sale.

10. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law (ACL) or any other law that cannot lawfully be excluded. Our goods come with guarantees that cannot be excluded under the ACL, including that they are of acceptable quality and fit for the purpose for which they are commonly bought. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage, and to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Where permitted by the ACL, our liability for a failure to comply with a consumer guarantee is limited, at our option, to the repair or replacement of the goods, or the cost of doing so.

11. Disclaimer of Warranties

While we are dedicated to crafting eyewear of the highest standard, all products and services are provided "as is" and "as available," except as set out in Section 10 (Australian Consumer Law) above.

We make no guarantees regarding uninterrupted access, or that our site will be error-free. Some jurisdictions do not allow limitations on implied warranties, so these disclaimers may not apply to you. Nothing in this section excludes, restricts, or modifies any guarantee, right, or remedy available to you under the Australian Consumer Law or other applicable law that cannot lawfully be excluded.

12. Limitation of Liability

To the fullest extent permitted by law, and subject to Section 10 (Australian Consumer Law), Balterra shall not be liable for any indirect, incidental, or consequential damages related to your use of our products or site.

13. Medical Disclaimer

Balterra products are not medical devices and are not intended to diagnose, treat, or cure any condition. Content on our site is educational. All spectral claims are independently spectrometer verified. For health concerns, please consult a qualified medical professional.

14. Governing Law

These terms are governed by the laws of Victoria, Australia. By using our Services, you consent to the jurisdiction of courts in Melbourne, Victoria.

15. Updates to Terms

We may update these Terms periodically. Any changes will be reflected on this page, with the effective date listed below. Continued use of our Services indicates your acceptance of the revised Terms.
